| Abstract | From year to year, new trade programs of individual countries appear, whereby partner countries provided the preferences for the export of their products. However, it is not always possible to participate therein since it depends on compliance with certain requirements. One such program at one time was the “Generalized System of Preferences “GSP” Program” implemented by the United States of America. Ukraine had been participating therein for some time before the partial exclusion due to non-compliance with the proper regime of intellectual property protection on our territory in April 2018. After Ukraine had implemented needed legislation with practical perspective, the USA took us back in the GSP Program. However, there were negative implications of Ukraine absence in the program during the exclusion term as the underachievement of profit on the part of local producers who previously exported products within the specified program. Meantime, such exclusion showed up certain issues of IP needed to be resolved. Considering that, we estimate all circumstances in question as positive. In this article, the authors will try to analyze this situation and show how participation in such programs may benefit the Ukrainian economy, as well as draw attention to other issues of legislative regulation in the field of intellectual property. Based on the results of the research, the authors conclude Ukraine has significant progress in this matter, participates in preferential trade programs of Western partners, develops the CMO institute and generally takes control over the issue of protection of rights in IP. At the same time, remain issues to be resolved, such as the actual creation of the High Court on Intellectual Property, work with the population on orientation to the legitimate use of other people's copyright objects and related rights, etc. | ||
